From Where Do Our Rights Derive?

I was reading [info]blackwingbear‘s post about the California Supreme Court hearing on whether Proposition 8 is a revision or amendment to the California Constitution, and I started thinking.  From where do our freedoms of speech and others derive?

Since there is nothing supernatural, it can’t be from any gods.  Since Kenneth Starr seems to think that a bare majority can strip said rights away from us, it most certainly can’t be from the people, neither.  So what is left?  If our rights don’t come from gods, and they can’t also come from the People, the only thing left is from the mere fact of our existence.

Perhaps we don’t have any rights at all that are inherent in the simple fact of existence, and that all our rights are given at whim by our fellow humans.
